Vacation Rental Agreement
Property Owner/Landlord: Blackbird Cabin Rentals (formally known as Mountain Shadows Resort & Rentals Address: 1455 East Parkway, Gatlinburg, Tennessee, 37738] Phone/Email: 865-356-4406, support@blackbirdcabins.com
Rental Amount: Total Rent includes Cleaning Fee, Rental Amount, and Taxes. Deposit: $200 Due upon booking. This is not a refundable security deposit. Remaining Amount: Due 1 day before arrival.
Cancellation Policy:
- Cancellations more than 30 days before check-in: Deposit refundable minus 10% credit card processing fee.
- Cancellations within 30 days: No refund. Guests must call the office if within 30 days prior to arrival and Owner may/may not move the reservation to another date in the form of a gift certificate that can be used within 1 year of reservation date.
- Owner may cancel for any reason with full refund if prior to check-in and problems occur.
- We highly suggest Travel Insurance be purchased just in case an emergency happens and you are unable to make it.
House Rules:
- No smoking inside the property.
- No parties or events without written permission.
- Quiet hours: 10 PM – 8 AM. The City of Gatlinburg has a Sound Ordinance throughout the entire city and surrounding neighborhoods.
- Pets allowed with prior approval and pet fee. Pet-friendly properties are listed as such and must be approved by Office. Pets must be on a leash when being walked in the resort. Pets must not be allowed to be on the furniture or beds and must be kenneled if left inside of the cabin alone. If excessive pet hair, feces, urine, or vomit is found within the cabin, your card on file will automatically be charged an extra $150.00 We love our pets at our own personal home, but we also need to respect the Owners and their properties that you have rented. Please pick up any pet waste when walking your pet as well. Pets must be trained and show control when inside of the resort. We are not liable for any problems that occur with your pet and other guest’s pets inside of the neighborhood. If your pet is reported for being aggressive, disorderly, or barking throughout the night, you will be asked to find another lodging source for your pet during your stay with us.
- Guests must not cause damage, cause excessive noise, or disturb neighbors. We want all guests to have a wonderful experience in our Resort. While we encourage family time and gatherings with your loved ones, please do this at respectable times that does not disrupt your neighbors. If we receive noise complaints past 10pm, we are required to call the City of Gatlinburg Police Department to visit the properties and a possible warning or citation could occur that is out of our hands. If your neighbors are being loud or throwing a party past 10pm, please contact our office. We do not manage every property in the Resort and most of the time, we have no control over the neighbors. - No illegal activities.
- Property must be left in reasonably clean condition (dishes done, trash out). Please put any wet towels in the bathroom before heading out. Our dumpsters are bear proof and located at our office at 1455 East Parkway, Gatlinburg, Tennessee 37738. If you are staying in a property outside of the resort, we have bear proof trash cans on the property’s site. Cages must be secure.
Responsibilities:
- Guest agrees to use the property responsibly and report any issues immediately.
- Owner provides the property in good, clean condition with working utilities and listed amenities.
- Guest is liable for any damage beyond normal wear and tear. If the property is damaged in any way, (including broken lamps, furniture, missing items, damaged linens or towels, broken windows, beds… Guest’s card on file will be charged for damages. Our cleaning teams take pictures throughout every clean of the way the property was taken care of before your arrival. We understand that mistakes happen, but it is important that you let us know. If you arrive to the property and something is not working properly or broken, please let us know immediately. We value your time with us and strive for a wonderful experience. It’s important that we work together and communicate to give you an exceptional stay.
- No subletting or assigning this agreement. Guests must be 21 to rent this property. Parents, Friends, or Guardians of underage guests are not allowed to book properties for underage attendees. We will not be held liable for parties, or underage drinking, and unsafe choices that can arise when an entire party is under the age of 21. I.d.’s must match the reservation and card on file. No Exceptions.
No Refunds for Unforeseen Events: No refunds, credits, or changes will be issued for cancellations, shortened stays, no-shows, late arrivals, early departures, or any interruptions due to weather conditions (including inclement weather, snow, rain, storms, or road conditions), acts of God/nature, natural disasters, power outages, family illness or injury, personal emergencies, or any other events beyond the Owner’s reasonable control. Guest is strongly encouraged to purchase travel insurance to protect against such risks.
Liability: Guest assumes all risk for personal injury or property loss during stay. Owner is not liable for theft, damage, or injury related to your stay with us.
Governing Law: This agreement is governed by the laws of Tennessee.
By booking and/or paying, the Guest accepts these terms. Both parties agree to the above.
